Terms of Use

1. Acceptance

These Terms of Use govern both the use of the 4420 website and the use of its sports facilities. By using the site, making a booking or entering the courts, the user declares that they have read, understood and accepted these Terms, as well as the Legal Notice. If they do not agree, they must refrain from using the site and the facilities.

Part A · Use of the website and bookings

 

2. Registration and account

To book, the user must provide truthful, complete and up-to-date information, in particular name, phone and email. The booking system may generate an account associated with that information. The user is responsible for the accuracy of the information provided and for the use of their account.

 

3. Online bookings

Bookings are made through the site, selecting an available court, date and time. The booking is subject to confirmation, which is communicated by email. 4420 reserves the right to reject or cancel bookings in the event of an obvious system error, actual lack of availability, or breach of these Terms.

 

4. Prices and payments

Booking prices are those indicated on the site at the time of booking. Payment may be made online or in person upon arrival at the facilities, according to the options enabled. Payments in foreign currency may be subject to the taxes applicable in Venezuela, including, where appropriate, the Tax on Large Financial Transactions (IGTF). Any applicable tax shall be governed by the regulations in force.

 

5. Cancellations and refunds

El usuario puede cancelar su reserva con al menos 24 horas de antelación al horario reservado, en cuyo caso tendrá derecho al reembolso del 100% de lo pagado.

Las cancelaciones realizadas con menos de 24 horas de antelación, así como la inasistencia sin aviso al horario reservado, no darán derecho a reembolso. En los casos en que la reserva no haya sido pagada por adelantado, el monto correspondiente a dicha reserva quedará como deuda pendiente a cargo del usuario, quien estará obligado a pagarlo. 4420 podrá exigir el pago de dicha deuda y condicionar futuras reservas a su cancelación.

4420 podrá modificar esta política, informándolo en el sitio.

4420 may reschedule or cancel a booking for reasons of maintenance, weather conditions, technical failures, events or force majeure. In such a case, it will offer the user a new available date or time or, at the user's choice, a refund of the amount paid.

 

6. Acceptable use of the site

The user agrees not to use the site for unlawful purposes, not to attempt to access restricted areas, not to introduce malicious code, and not to carry out actions that may damage, overload or affect the operation of the site or the rights of third parties.

 

Part B · Use of the courts and facilities

 

7. Access to the facilities

Access to the courts is reserved for users with a valid booking and their authorized companions. Users are advised to arrive a reasonable time before the start of their session. Each booking corresponds to the contracted time; play time is not extended due to the user's late arrival.

 

8. Rules for use of the courts

  • Use the courts and equipment in accordance with their purpose and the staff's instructions.
  • Wear appropriate sports footwear that does not damage the playing surface.
  • Keep the facilities clean and in good condition, and remove any waste.
  • Do not enter the playing areas with food or drinks, except in the areas designated for that purpose.
  • Immediately report any damage or hazardous situation to the staff.
  • Respect the schedules, the other users and the staff's instructions.

 

9. Consumption at the cafeteria

The consumption of food and drinks within the facilities takes place in the areas designated for that purpose. The prices and conditions of the café are those indicated at the point of sale.

 

10. User's health and physical fitness

The user declares that they are in adequate physical and health condition for sports practice. It is the user's sole responsibility to know their own limitations and to consult a health professional if they have any doubts. 4420 does not perform medical evaluations and is not responsible for pre-existing or undisclosed health conditions.

 

11. Minors

Minors must use the facilities under the supervision and responsibility of their parents, guardians or authorized caretakers, who are responsible for their safety, conduct and for any damage they may cause, in accordance with the Organic Law for the Protection of Children and Adolescents (LOPNNA). The responsible adult accepts these Terms also on behalf of the minor in their care.

 

12. Assumption of risk and liability waiver

The user understands and accepts that the practice of pickleball and of any sporting activity involves inherent risks, including falls, blows, physical injuries of varying severity and even, in extreme cases, more serious harm. The user participates voluntarily, with knowledge of such risks and under their sole responsibility.

To the extent permitted by Venezuelan law, the user releases 4420, its operators, staff and representatives from liability for injuries, accidents, ailments or damages arising from sports practice or the use of the facilities, except for those resulting from willful misconduct or gross negligence attributable to 4420. In the event of any accident, the user must immediately inform the staff to activate the corresponding care protocol.

 

13. Damage to the facilities

The user shall be responsible for any damage that they or their companions cause to the courts, the equipment or the facilities through improper use, negligence or breach of the rules, and shall bear the corresponding repair or replacement costs.

 

14. Personal belongings, loss and theft

4420 is not responsible for the loss, misplacement, damage or theft of users' personal belongings within the facilities. Users are advised not to leave valuables unattended.

 

15. Conduct and right of admission

4420 reserves the right of admission and of continued stay. It may deny access to or remove from the facilities anyone who breaches these Terms, behaves aggressively or dangerously, damages the facilities, or is in a state of intoxication or under the effects of substances that alter their behavior, without any right to a refund.

 

16. Force majeure

4420 shall not be liable for the breach of its obligations when this is due to force majeure or unforeseeable circumstances beyond its control, including, among others, public utility failures, weather conditions, natural disasters or orders from the authorities.

 

17. Amendments

4420 reserves the right to modify these Terms at any time. Amendments shall take effect upon their publication on the site. Continued use of the site or the facilities implies acceptance of the version in force.

 

18. Applicable law and jurisdiction

These Terms are governed by the laws of the Bolivarian Republic of Venezuela. For any dispute, the parties submit to the competent courts of the city of Caracas, unless otherwise provided by law.

 

19. Acceptance

Use of the site, making a booking or entering the facilities implies full acceptance of these Terms of Use and the Legal Notice.
